Horsemanship Program & Equestrian Activities
Liability Waiver, Assumption of Risk, and Indemnity Agreement
PLEASE READ THIS AGREEMENT CAREFULLY BEFORE BOOKING OR PARTICIPATING IN ANY SAGEBRUSH N SADDLES ACTIVITY.
By booking an appointment, lesson, class, horsemanship experience, or other equestrian activity with Sagebrush N Saddles, you acknowledge that you have read, understood, and agreed to the terms below.
1. ACKNOWLEDGMENT OF RISK AND UTAH EQUINE ACTIVITY LIABILITY ACT
I understand that horsemanship and equine activities involve inherent risks. These risks include, but are not limited to:
The unpredictable nature and behavior of horses
Falls from or around horses
Being kicked, bitten, stepped on, or struck by a horse
Collisions with objects, other horses, animals, or people
Equipment failure
Injuries occurring while riding, mounting, dismounting, grooming, handling, or otherwise interacting with horses
Serious injury, permanent disability, or death
I voluntarily assume all risks related to my participation, or my minor child's participation, in equine activities, whether those activities occur on or off the premises of Sagebrush N Saddles or Wasatch View Ranch.
WARNING
Under Utah law, an equine activity sponsor or equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities.
2. RELEASE OF LIABILITY AND INDEMNIFICATION
In consideration of being permitted to participate in equine activities, I, on behalf of myself and my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue Sagebrush N Saddles, Wasatch View Ranch, Kathleen Bauer, and their owners, officers, agents, employees, instructors, volunteers, and affiliates (collectively, the “Released Parties”) from any and all liability, claims, or causes of action for any injury, loss, or damage, including death or property damage, arising out of participation, whether caused by negligence or otherwise, to the fullest extent allowed by law.
I further agree to indemnify, defend, and hold harmless the Released Parties from any third-party claims, damages, or costs, including attorney's fees, arising from my or my minor child's actions or participation in any activities.
3. HELMET POLICY
I understand that a properly fitted and secured equestrian helmet is an important safety device.
Participants Under 16
Participants under 16 years of age are required to wear a properly fitted and secured equestrian helmet at all times while riding or handling horses. No helmet waiver is permitted for participants under 16.
Participants Ages 16–17
Participants ages 16–17 are required to wear a properly fitted and secured equestrian helmet unless the participant's parent or legal guardian provides consent for the participant to waive the helmet requirement.
By consenting to the helmet waiver, the parent or legal guardian acknowledges and accepts the increased risk of serious head injury or death associated with participating without a helmet.
Participants 18 and Older
Participants 18 years of age and older are strongly encouraged to wear a properly fitted and secured equestrian helmet.
An adult participant may voluntarily choose not to wear a helmet and accepts the increased risk of serious head injury or death associated with that choice.
By agreeing to this waiver, I acknowledge and agree to comply with the helmet requirements applicable to my age and understand the risks associated with choosing not to wear a helmet when permitted.
4. CONSENT TO EMERGENCY MEDICAL TREATMENT
I authorize the Released Parties to seek emergency medical treatment for me or my minor child if needed.
I accept full responsibility for all associated medical, emergency transportation, and related costs.
5. PHOTO AND VIDEO RELEASE
I understand that photographs and video may be taken during Sagebrush N Saddles activities.
By agreeing to this waiver, I consent to Sagebrush N Saddles and the Released Parties photographing or recording me or my minor child during activities and using those photographs or recordings for promotional, advertising, social media, website, or other business-related purposes without compensation.
If I do not consent to the use of my or my minor child's photographs or video, I understand that I must notify Sagebrush N Saddles in writing before participation.
Unless Sagebrush N Saddles has received written notice that I do not consent, my agreement to this waiver includes permission for the use of photographs and video as described above.
6. ADDITIONAL TERMS
No Therapy or Medical Services
I understand that Sagebrush N Saddles does not provide psychotherapy, counseling, medical treatment, or licensed therapeutic services.
Participation in Sagebrush N Saddles activities is educational or recreational only.
Participant Conduct
I agree to follow all rules, instructions, and safety guidelines provided by Sagebrush N Saddles, its instructors, staff, and facility personnel.
Failure to follow rules, instructions, or safety guidelines may result in immediate removal from activities without refund.
Equipment Responsibility
I understand that equipment provided by Sagebrush N Saddles may not eliminate the risks associated with equine activities.
I understand that proper equipment fit and appropriate use are my responsibility.
Insurance
I understand that Sagebrush N Saddles does not provide personal accident, medical, or health insurance coverage for participants.
Governing Law and Venue
This Agreement shall be governed by the laws of the State of Utah.
Any legal action shall be brought in a court of competent jurisdiction in the county where Sagebrush N Saddles operates.
Severability
If any part of this Agreement is held to be invalid or unenforceable, all other parts shall remain in full force and effect.
No Guarantees
I understand that participation in Sagebrush N Saddles activities does not guarantee any specific outcome, level of performance, or skill development.
7. ONLINE ACKNOWLEDGMENT AND AGREEMENT
By booking an appointment, lesson, class, horsemanship experience, or other activity with Sagebrush N Saddles, I acknowledge that I have read and understand this entire Liability Waiver, Assumption of Risk, and Indemnity Agreement.
By submitting my booking, I agree to be bound by all of the terms and conditions contained in this agreement, including the assumption of risk, release of liability, indemnification provisions, safety requirements, helmet policy, photo and video release, and participant conduct requirements.
I understand that participation in equine activities involves inherent risks, including the possibility of serious injury, permanent disability, or death.
I voluntarily assume these risks and agree to follow all safety instructions, rules, and policies provided by Sagebrush N Saddles, its instructors, staff, and facility personnel.
If I am booking for a minor participant, I confirm that I am the participant's parent or legal guardian and have the authority to agree to these terms on the minor's behalf.
I understand that this agreement is intended to be a legally binding contract to the fullest extent permitted by law.
FINAL ACKNOWLEDGMENT
I HAVE READ, UNDERSTAND, AND AGREE TO THE SAGEBRUSH N SADDLES LIABILITY WAIVER, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT. BY SUBMITTING MY BOOKING, I ACKNOWLEDGE MY ELECTRONIC ACCEPTANCE OF THIS AGREEMENT.
